Fishing is dangerous work, and fishermen ought therefore to have an extensive right to compensation if they are physically injured in an accident while doing their work. They therefore do not have to prove that the accident may be attributed to events for which an employer is responsible, e.g., that conditions and work procedures were not in good order; equipment was broken or defective, or another employee made a mistake causing the accident.
This right of fishermen is most similar to the right of those carrying comprehensive collision insurance.
A fisherman can have a right to compensation for temporary loss of income, suffering, chronic pain and permanent financial disability. In addition a victim has a right to repayment of some out-of-pocket expenses because of the accident.
The relatives of someone dying in an accident while working at sea have a right to repayment of funeral expenses, and close relatives, especially the spouse and children, can have a right to compensation for loss of a provider.
Fortis’s attorneys can assist fishermen in checking their rights to compensation because of an accident while working at sea.
